A violent thug who repeatedly stamped on his neighbour’s head until he lost consciousness has been locked up. Joshua Tumilty carried out a shocking attack in the street during a spate of other offences.
Newcastle Crown Court heard it was around 11.45am on November 11 last year that Tumilty became involved in a confrontation with a man in the street. Oliver Conner, prosecuting, said: “It appears they were neighbours. Other neighbours were alerted to the altercation by shouting.
“The victim began to run away from him and he followed him a short distance before taking hold of him and throwing him to the floor. Once he was on the ground he kicked him in the head twice and stamped on his head twice.
“The complainant tried to get up but he pushed him back down before stamping on his head again. He was pushed back to the ground again and he kicked him again.
“The victim was, by this time, visibly bleeding from the head. He then stamped eight further times on his head as he began to lie on the ground unresponsive.”
Having walked away, Tumilty, 34, of Benson Road, Newcastle, then went back up to the victim and shouted at him but he was lying on the ground motionless and unresponsive.
The court heard the victim suffered two fractures to his pelvis, a fractured hand, cuts and bruises to his body, swelling and an injury which needed stitches above his eyebrow. He was in hospital for 13 days and the attack affected his mobility and he no longer drives.
He pleaded guilty to GBH with intent. While Tumilty was in custody having been arrested, he assaulted a police officer.
He also admitted a series of other offences including on July 29 2024, when he assaulted police officers. Between September 2 and 11, he stole chocolate, confectionary and biscuits worth hundreds of pounds from shops on four occasions. After being arrested, he spat on a police officer when he opened his cell hatch.
On September 17, around 6.30am, residents on Morton Street, Newcastle, were woken to the sound of shouting in the street. Tumilty and another man were shouting and fighting.
Both were armed with weapons, with Tumilty picking up a long piece of wood which he used to hit the other man, who hit him with a hammer. He admitted affray in relation to that.
For all of the offences, he was jailed for a total of four years and nine months.
Rachel Hedworth, defending, said his mental health had declined at the time. She added: “He is, in the cold light of day, absolutely sickened and horrified by his offending in terms of the violent behaviour.
“He does not recognise the person in the footage. He has found it very difficult to view the footage and read the effect his behaviour has had on others. He is very very remorseful for his behaviour.”
