The jury in Donald Trump’s hush money trial ended its first day of deliberations without a verdict Wednesday but asked to rehear testimony from key witnesses about the alleged hush money scheme at the heart of the history-making case. The 12-person jury was sent home around 4 p.m. after about 4 1/2 hours of deliberations. The process is to resume Thursday, when jurors are expected to rehear the requested testimony and at least part of the judge’s legal instructions meant to guide them on the law. The notes sent to the judge with the requests were the first burst of communication with the court after the panel of seven men and five women was sent to a private room just before 11:30 a.m. to begin weighing a verdict. “It is not my responsibility to judge the evidence here. It is yours,” Judge Juan M. Merchan told jurors before dispatching them to begin deliberations, reminding them of their vow during the selection process to judge the case fairly and impartially. Bryan Thomas | Getty Images A federal appeals court agreed to rehear a challenge by two conservative groups to Nasdaq’s board diversity rule related to the disclosure of women and minority membership on boards of companies listed on the stock exchange. The 5th Circuit U.S. Court of Appeals, in its order Monday night setting a rehearing, also vacated a decision in October upholding the Nasdaq rule by a three-judge panel from the appeals court, which encompasses Texas, Louisiana, and Mississippi. The Nasdaq rule requires companies to disclose details about the diversity of their boards of directors and to either have a minimum number of women and minorities on their boards or explain why they do not. The 5th Circuit’s order Monday said it will reconsider the challenge to the Securities and Exchange Commission’s approval of the Nasdaq rule, with the full lineup of judges on that court rehearing the case in a so-called en banc proceeding. Appeals court won’t rehear Trump gag order appeal, leaving Supreme Court as final option

WASHINGTON — The U.S. Circuit Court of Appeals for the District of Columbia has declined to rehear former President Donald Trump’s appeal of the gag order imposed on him in the federal election interference case. Trump had submitted requests for rehearing his appeal to both the three-judge panel that originally heard the appeal and the full D.C. circuit court. No judge on the full bench requested a vote on Trump’s motion, which means it was automatically dismissed.  To appeal the gag order further, Trump would have to bring it before the Supreme Court. U.S. District Judge Tanya Chutkan, who’s overseeing the election interference case brought by special counsel Jack Smith against Trump, imposed a gag order on the former president last year after he shared disparaging messages on social media about key people involved in the case. Trump has explicitly taken aim at Chutkan as well as Smith and other prosecutors in his office as well as potential witnesses in the case.
